Mi•shᵊpât•im 1st Eve (Mo•tzâ•ei Shab•ât Beginning Week)

“So these are the Mi•shᵊpât•im:”

(Amalgamated Tribal Laws/Tza•diq•ūt)

Nonpareil Quintessence of é‑‑ä

B.C.E. 1st century — Rabi Hi•leil, when asked by a gentile to be converted while the Rabi stood on one foot, replied: "That which you eschew, don’t inflict on your fellow! That's the entirety of Tōr•âh. What remains is pei•rush•âh. Now, go-weave your lifetime-learning-practice.”

é''ã‎ Liability Incurred When Securing Property

security
Securing property – e.g., brick & mortar bank, online banking v cyber crime

If a man give his fellow money or items to secure, and the secured property be stolen from the securer's premises and the thief be found, then the thief shall pay complete restitution plus an equal amount in punitive damages.

If the thief isn't found, then the baal ha-bayit shall approach the ma•lᵊâkh ha-ël•ōh•im to discern whether or not he has stuck his hand into his fellow's mᵊlâkh•âh.

For every felony charge brought before the court, whether it concerns working issues, transportation issues or the food industry, whether it's for clothing or any lost property that someone identifies as his or hers, the matter, with arguments from both parties, shall come before the ma•lᵊâkh ha-ël•ōh•im.

Whomever the ma•lᵊâkh ël•ōh•im convicts as rësha shall pay double restitution to his fellow.

Optional parental preparation:

  1. What does it mean "to secure" something?

  2. What is the difference between restitution and punitive damages?

  3. What does it mean "to stick one's hand in your fellow's mᵊlâkh•âh (business)?

  4. What does "convict" mean? What does the presumption of innocence mean?

  5.  22.07, Ma•lâkh – Implied by the well-established prohibition against anthropomorphism. A man pleading innocence cannot publicly "come near," or talk with, ha-ël•ōh•im. In fact, no one can prove in a court of law that they talk with ha-ël•ōh•im! Ergo, ha-ël•ōh•im can only refer to the human shō•pheit (appointed in the Name of é‑‑ä as a ma•lâkh é‑‑ä).

Further (v, 8), except for hearing the verdict of the human shō•pheit, having ruled out anthropomorphism means that the pubic would have no Voice to communicate to them whom ha-ël•ōh•im judged to be wicked; thus, consistently confirming that ha-ël•ōh•im can only refer to a ma•lâkh é‑‑ä.Return to text

Questions you might anticipate that your child might raise and be prepared to discuss:

  1. What does "premises" mean?

  2. If you borrow a toy from a friend, what is your responsibility to return it to him or her in the same condition as when you borrowed it? What if a dog or cat chews it up and ruins it? What if you leave it out in the rain and it is ruined? What if a bully threatens to take a toy you've borrowed? What if a bigger sibling ruins the toy in your custody? What does "custody" mean?

  3. If a friend borrows a toy, what are his or her responsibilities to you to return it in the same condition you loaned it to him or her?
