“So these are the Mi•shᵊpât•im:”

(Amalgamated Tribal Laws/Tza•diq•ūt)

Nonpareil Quintessence of é‑‑ä

B.C.E. 1st century — Rabi Hi•leil, when asked by a gentile to be converted while the Rabi stood on one foot, replied: "That which you eschew, don’t inflict on your fellow! That's the entirety of Tōr•âh. What remains is pei•rush•âh. Now, go-weave your lifetime-learning-practice.”

If a man shall place livestock in the care of his fellow, whether the animal is his "ride" (i.e. used for transport), his "tractor" (i.e. to accomplish work) or raised for food, if the secured livestock dies in the fellow's custody, or suffers a broken bone or is rustled unseen, then a cross-examination with the oath of é‑‑ä shall be administered between both of them to discern whether he hasn't intruded his hand into his fellow's mᵊlâkh•âh. The animal's baal shall accept the oath that no embezzlement is involved and the securer will not be required to pay remuneration.

But if the animal is rustled by a rustler, then he shall pay restitution to the animal's baal since he assumed responsibility for securing the animal.

If the animal is utterly tâ•reiph, the carcass shall be brought to court as hard evidence that he is innocent of embezzlement.

è''å‎ 1. Liability For Rented Livestock

If the animal's baal was with the animal when the loss occurred, then the securer is absolved of responsibility for the loss and not be required to pay restitution.

If the animal was rented for work or transport, then the renter, being responsible, shall, in addition, also forfeit the rental money.

Optional parental preparation:

  1. What does "absolve" mean?

  2. How is a cross-examination different from an ordinary examination or questioning? From an interview?

  3. What is an oath?

  4. What does "embezzle" mean?

Questions you might anticipate that your child might raise and be prepared to discuss:

  1. What does "liability" mean? "Incur"?

  2. What does "rent" mean?
